These terms cover your use of eleven89.org and, in outline, how Eleven89 LLC ("we") works with clients. Specific engagements are governed by a written proposal or agreement, which takes precedence over anything here.
Use of this website
The site is provided for information about our services. You may not use it to send unsolicited messages, to probe or disrupt our systems, or for any unlawful purpose. We may change or remove content at any time.
Engagements
- Working sessions and retainers are billed at the rates published on this site at the time of purchase, or as stated in your proposal.
- Hour blocks are prepaid. Retainer hours are billed monthly in advance and do not roll over.
- Fixed-price projects are quoted in writing after a scoping session and are payable on the schedule in the quote.
- Third-party costs, such as hosting, model usage, data sources, and domain registrations, are passed through at cost unless the quote says otherwise.
- Either party may end a retainer with 30 days' written notice.
Ownership
On payment in full, you own the deliverables we build specifically for you. We keep ownership of our pre-existing tools, templates, and infrastructure, and grant you a licence to use them as part of your deliverables. Where we host something for you, we will hand over the code and data on request.
Confidentiality
We keep client information confidential and use it only for the work. We do not name a client publicly without their agreement.
Text messaging
By giving us a phone number and consenting on the contact form, you agree to receive SMS messages from us about your enquiry or project. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. See our privacy policy for how phone numbers are handled.
Warranties and liability
We do the work with reasonable skill and care. Beyond what is set out in a signed agreement, the website and its content are provided as is, and our total liability arising from any engagement is limited to the fees you paid for it. Nothing here limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the United States and the state in which Eleven89 LLC is registered. Any dispute will be handled in that state's courts unless we agree otherwise in writing.
